Any business or organization that seeks to purchase electronic personal information, such as motor vehicle records, from the Arizona Department of Motor Vehicles (DMV) must be bonded. The bond required is an Arizona Electric Records Access Bond, also called an Arizona MVR Bond.

This bonding requirement is set by the Arizona Department of Transportation (ADOT).

What is an Arizona Electronic Records Access Bond?

An Arizona Electronic Records Access Bond is a financial assurance. This surety bond ensures that the business receiving personal electronic information will pay for financial damages if they commit fraud while accessing or distributing public records.

If they use the information unlawfully, ADOT or any other affected party can make a claim against the bond to help recoup losses.

Every Arizona Electronic Records Access Bond is a contract between three parties:

  1. Principal – the company applying to access electronic information from ADOT.
  2. Obligee – the organization asking the principal to get bonded (ADOT).
  3. Surety – the company that issues the bond (ex. Lance Surety Bonds). They will initially pay for any bond claims. However, the principal must then pay them back in full.

Why is the Bond Required?

This bond is in place to protect ADOT and the public. It deters fraud by guaranteeing that the business pulling public records is financially liable if they commit fraud or otherwise misuse the information, as outlined in the Arizona Revised Statutes, Title 28, Chapter 2, Article 5.

How Much Does an Arizona Electronic Records Access Bond Cost?

An Arizona Electronic Record Access Bond costs as little as $100. The cost of this bond is based on how many public records you pull monthly and your credit score.

  • Monthly Record Volume – the estimated highest number of records you will pull in a month determines the amount of your bond (penal sum). Say it's 200 records and each record costs $6. You will take that amount and multiply it by 3 to get your penal sum.

    $6 x 200 = $1,200

    $1,200 x 3 = $3,600 (penal sum)

 

  • Your Credit Score – Using the example above, the bond required needs to be in the amount of $3,600. However, this is not how much your bond costs—you only pay a small fraction of this. The percentage you pay is based on your credit score. See the chart below.

How to get an Arizona Electronic Records Access Bond

Bond Renewal and Cancellation

Your bond must be renewed annually if you access records for over 12 months. The exception is if you are on a monthly payment plan or have a multi-term bond. Note that your bond must be active for as long as you have been granted access to electronic records.
