What is an Idaho Auto Dealer Bond?

An Idaho auto dealer bond, formally called a Vehicle or Vessel Dealer Bond, is a surety bond required by the Idaho Transportation Department before certain dealer licenses can be issued.

It is a financial guarantee that your dealership will follow Idaho dealer laws and deal honestly with customers. If a dealer commits fraud, misrepresents a vehicle, violates Idaho dealer rules, or fails to meet legal obligations, a harmed customer can make a claim against the bond.

Unlike insurance, which protects your business, a surety bond primarily protects customers and the state. If a valid claim is paid, you are responsible for reimbursing the surety company.

Every surety bond is a contract between 3 parties:

  • The Obligee: Idaho Transportation Department
The state authority that requires the bond as a condition of dealer licensing. They set the bond amount and terms.

  • The Principal: You, the dealer
You purchase the bond and are bound by its terms. If a valid claim is paid, you must reimburse the surety.

  • The Surety: such as Lance Surety Bonds
We underwrite the bond and guarantee payment to claimants up to the bond amount if you default on your obligations.

How Much Does an Idaho Auto Dealer Bond Cost?

The cost of an Idaho auto dealer bond starts at $200 for retail dealers, assuming a $20,000 bond amount. Wholesale-only dealer bonds start at $400, based on Idaho's $40,000 bond requirement. Dealers who sell only motorcycles, ATVs, UTVs, truck campers, or snow machines may need a $10,000 bond, with premiums starting at $100.

It's important to understand the difference between the bond amount and what you actually pay. The bond amount is the maximum a claimant can recover against your bond. Your cost is the annual premium, which is usually a small percentage of that amount.

Your premium is quoted individually based on three factors: your personal credit score, your experience in the industry, and any prior bond claims on your record. Because each surety company weighs these factors differently, the same applicant can receive different quotes from different underwriters.

Even applicants with poor credit can get bonded. A lower credit score usually means a higher premium, not an automatic denial.

Here's a breakdown of Idaho bond requirements and estimated premium costs based on credit score.

Who Needs a Bond in Idaho?

The Idaho Transportation Department requires vehicle and vessel dealers to file a performance bond when applying for a dealer license.

  • Retail dealers - Retail vehicle or vessel dealers must file a $20,000 bond.
  • Wholesale-only dealers - Wholesale-only dealers must file a $40,000 bond.
  • Motorcycle, ATV, UTV, truck camper, and snow machine dealers - Dealers selling only these vehicle types must file a $10,000 bond.
  • Vehicle or vessel dealers - Idaho's bond requirement applies to vehicle and vessel dealers. The bond amount depends on the type of dealership and the vehicles or vessels being sold.
  • Certain auction activities - Some auction activities require an Idaho dealer license. If the auction activity requires a dealer license, the correct bond amount depends on the license type.
  • Dealers selling five or more vehicles or vessels per year - Idaho generally requires a dealer license if a person sells, displays, exchanges, or consigns five or more titled vehicles or vessels in a calendar year.

What Happens If Someone Files a Claim?

The bond protects consumers from financial loss caused by dealer fraud, misrepresentation, or violations of Idaho dealer laws.

A claim can be filed for issues such as:

The maximum payout is the bond's penal sum: $20,000 for retail dealers, $40,000 for wholesale-only dealers, or $10,000 for qualifying specialty dealers. After any payout, you as the principal are liable to reimburse the surety.

How the Claims Process Works

  • Consumer or claimant contacts the surety company directly to file a claim
  • The surety investigates the claim to determine its validity
  • If the claim is valid, the surety pays the claimant up to the bond's penal sum
  • The dealer then reimburses the surety for any amount paid
  • Claims on your record can increase your bond premium at renewal

Renewing Your Idaho Auto Dealer Bond

Idaho Vehicle or Vessel Dealer Bonds are issued on a continuous basis. The bond does not have a fixed expiration date and remains active until canceled by the surety company.

Even though the bond runs continuously, you still need to pay your premium annually to keep the bond active. If the surety cancels the bond, it must provide 30 days' written notice by certified mail to the Idaho Transportation Department, with a copy sent to the dealer.

Retail vehicle dealers should also be aware of the Idaho Consumer Asset Recovery Fund, also called ICAR. Retail dealers are required to pay into ICAR as part of initial licensing and renewal. Idaho also notes that dealers who have operated for at least three consecutive years without bond lapses, bond claims, or ICAR judgments may have the option to operate without a bond, but you should confirm eligibility with Dealer Services before making any changes.

How to Get Your Auto Dealer License in Idaho

Getting an Idaho vehicle or vessel dealer license is a detailed process handled by the Idaho Transportation Department.

To apply, you generally need to submit:

  • Completed Idaho vehicle or vessel dealership license application
  • Surety bond
  • Business entity documents, if applicable
  • Zoning approval
  • Franchise documentation, if selling new vehicles or vessels
  • Pre-licensing education certificate for used-only and wholesale-only dealers
  • Sales tax permit number for retail dealers
  • Employer Identification Number
  • Personal history form for each owner, officer, partner, or director
  • Verification of business phone number
  • Certificate of liability insurance
  • Required application and ICAR fees, if applicable

Used-only and wholesale-only dealer applicants must complete pre-licensing education before applying. The Idaho Transportation Department may also assign a Motor Vehicle Investigator to inspect the dealership location before a permanent license is issued.

You can find the full dealer licensing information on the Idaho Transportation Department website.

Frequently Asked Questions

How long does it take to get an Idaho dealer bond?

For most applicants, bonds can be issued the same day, often within minutes of completing the application. Your bond can be delivered digitally by email, and a paper copy can be mailed if needed.

What is the difference between the bond amount and the bond premium?

The bond amount is the maximum protection available to claimants. In Idaho, the required bond amount is $20,000 for retail dealers, $40,000 for wholesale-only dealers, and $10,000 for certain specialty dealers. The bond premium is what you pay each year to purchase and maintain the bond.

What happens if my bond lapses?

If your bond lapses or is canceled without replacement, you may no longer be in compliance with Idaho dealer licensing rules. This can put your dealer license at risk, so the bond premium should be paid on time each year.

Can my bond be cancelled?

Yes. The surety company can cancel the bond by giving 30 days' written notice by certified mail to the Idaho Transportation Department. A copy of the cancellation notice must also be sent to the dealer.

Do I need a bond for every salesperson I employ?

No. Idaho's dealer bond is tied to the dealership license, ownership, DBA, and dealership location listed on the application. Salespeople may still need proper licensing paperwork, but Idaho does not use the same separate salesperson bond structure found in some other states.

Do I need a separate bond for each dealership location?

The bond must match the exact ownership, DBA, and dealership location listed on the Idaho dealer license application. If you operate more than one licensed location, confirm the bonding requirements with Dealer Services before filing.
