What is an Ohio Auto Dear Bond?

An Ohio auto dealer bond, also known as Ohio Used Motor Vehicle Dealer Bond or Motor Vehicle Title Defect Surety Bond, is a surety bond required for used motor vehicle dealers before a license can be issued. The requirement is set under Ohio Administrative Code 4501:1-3-11.

The bond is posted in favor of the State of Ohio and is used to replenish the Title Defect Recision Fund when funds are paid to compensate retail purchasers who suffer covered title-related losses.

It is a financial guarantee that your dealership will follow Ohio dealer licensing laws and deal honestly with customers. If you fail to do so, a harmed customer may be able to recover losses through the bond or the state fund process.

Unlike insurance, which protects you, a surety bond primarily protects your customers and the state. If a valid claim is paid out, you are responsible for reimbursing the surety company.

 

Every surety is a contract between 3 parties:

  • The Obligee: State of Ohio, Bureau of Motor Vehicles / Ohio Attorney General’s Office

The state authority that requires the bond as a condition of licensing. They set the bond amount and terms.

  • The Principal: You, the dealer

You purchase the bond and are bound by its terms. If a valid claim is paid, you must reimburse the surety.

  • The Surety: such as Lance Surety Bonds

How Much Does an Ohio Auto Dealer Bond Cost?

The Ohio used motor vehicle dealer bond amount is $75,000. Ohio increased the surety bond requirement from $25,000 to $75,000, effective April 1, 2026. The bond may also be used to satisfy Ohio’s $75,000 net worth requirement for used dealer applicants under Ohio Administrative Code 4501:1-3-11.

You do not pay the full $75,000 bond amount. The $75,000 is the maximum coverage limit available under the bond, not your out-of-pocket cost. What you pay is the annual premium, which is a percentage of the bond amount.

For applicants with strong credit, Ohio auto dealer bond premiums commonly start around 1% to 3% of the bond amount. That means a $75,000 bond may cost about $750 to $2,250 per year for well-qualified applicants.

Your premium is quoted individually based on your personal credit score, business financials, dealership experience, and any prior bond claims on your record. A lower credit score usually means a higher premium, not an automatic denial.

Even applicants with poor credit can get bonded. A lower credit score means a higher premium, not a denial.

How to Get a Ohio Auto Dealer Bond

1. Submit Your Bond Application

Who Needs a Bond in Ohio?

The Ohio dealer bond requirement applies to used motor vehicle dealer license applicants covered by Ohio Administrative Code 4501:1-3-11. The following applicants may need to post the $75,000 bond before receiving or maintaining a license.

  • Used motor vehicle dealers - Businesses that sell used passenger vehicles to retail customers.
  • Used motorcycle dealers - Dealers primarily selling used motorcycles.
  • Used off-highway motorcycle dealers - Dealers selling used off-highway motorcycles under the used dealer license structure.
  • Used all-purpose vehicle (APV) dealers - Dealers selling used APVs.
  • New vehicle dealers with a used dealer license - A new dealer that also holds a used dealer license may need to meet the used-dealer bond requirement.
  • Certain exempt applicants - Ohio rules include limited exceptions, including for some leasing dealers or dealers with qualifying prior licensing history. Confirm your status with Ohio BMV Dealer Licensing before assuming you are exempt.

Ohio no longer uses the same separate salesperson bond structure found in some other states, so this page does not include a separate salesperson bond requirement.

What Happens If Someone Files a Claim?

The Ohio dealer bond protects consumers and the state by helping replenish the Title Defect Recision Fund when a retail purchaser suffers a covered loss related to a vehicle title issue. 

A claim or fund-related issue can arise from problems such as: 

  • Failing to provide a valid certificate of title after a vehicle sale.
  • Selling a vehicle without a proper title or ownership rights.
  • Misrepresenting the title status or ownership history of a vehicle.
  • Failing to comply with Ohio used dealer licensing laws.
  • Other conduct that causes compensation to be paid from the Title Defect Recision Fund.

The maximum payout tied to the bond is the bond’s penal sum: $75,000.  After any payout, you, as the principal, are liable to reimburse the surety.

How the Claims Process Works?

  • A consumer or claimant files a complaint or claim with the appropriate state or surety channel.
  • The claim is reviewed to determine whether it is valid under the bond and Ohio law.
  • If the claim is valid, the surety may pay up to the bond’s penal sum.
  • The dealer is then required to reimburse the surety for any amounts paid out.
  • Claims on your record will significantly increase your bond premium at renewal 

Renewing Your Ohio Auto Dealer Bond

Ohio used motor vehicle dealer licenses and dealer plates are renewed on the state’s renewal schedule, and your bond must remain active for the entire period in which the license is held.

If the bond is cancelled, Ohio must receive advance notice. You should replace the bond before cancellation takes effect to avoid a lapse in compliance.

Most Ohio dealer bonds are issued on a continuous basis or for annual terms, depending on the surety. You typically won’t need to file a new bond each year unless your bond form changes, your surety changes, or Ohio requests updated documentation.

At renewal, the surety company may review your credit and business profile. Maintaining a strong credit profile and avoiding claims can help keep your premium costs low.

How to Get Your Auto Dealer License in Ohio

  • In general, applicants should be prepared to complete these steps:
  • Choose the correct license type, such as a new vehicle dealer or a used motor vehicle dealer.
  • Register the business entity or trade name with the Ohio Secretary of State.
  • Obtain a Federal Employer Identification Number, Ohio tax registration, and county vendor number.
  • Secure a compliant dealership location with zoning approval, signage, business hours, photos, and other location documentation.
  • Submit owner, partner, trustee, member, or principal officer information, including required criminal history records.
  • Complete the required used motor vehicle dealer training course if applying as a first-time used dealer applicant.
  • Purchase and file the $75,000 surety bond if required for your used dealer license.
